1. The Reward

1.1 The promoter of the “NHS Fuel Discount” is making a discount available for a limited period of time to NHS staff, as described in these terms and conditions (the “Reward”). 

1.2 The promoter of the Reward is Essar Oil (UK) Ltd (the “Promoter”). 

1.3 The NHS Discount is available at the Essar filling stations operated by owners of the sites set out in the Schedule (the “Participating Sites”).

1.4 The Promoter and the owners of the Participating Sites are working together to offer a reduction of 10 pence per litre on any fuel purchased by NHS employees and workers from Participating Sites (the “NHS Fuel Discount”).

2. Eligibility

2.1 To be eligible for this Reward you must:

• be a resident of Great Britain aged 18 or over; and
• an employee or worker for the NHS; and
• hold a current original photographic NHS identity card in your own name,

(an “Eligible Customer”).

2.2 This Reward is not available to anyone who is not an Eligible Customer. 

2.3 Employees of the Promoter, or workers at the Participating Sites, agents or anyone else professionally or personally connected with this Reward are not Eligible Customers.

3. Duration and Availability

3.1 Subject to availability, the Reward runs for the period from and including 09:00 BST on 18^th January 2021 until and including 23:59 BST 28^th February 2021 (the “Initial Reward Period”). 

3.2 The Reward is subject to the availability of Essar fuels at Participating Sites which might be interrupted from time to time by stock ordering and replenishment processes and/or difficulties caused by the Covid-19 pandemic. 

3.2 The Promoter reserves the right to end this Reward early if circumstances beyond its reasonable control adversely affect its ability to provide or administer the Reward.  No further discounts will be available once this Reward has ended.  Posters relating to the Reward will be withdrawn from Participating Sites and we will place notices within Participating Sites informing the public that the Reward has ended.

4. How to claim your NHS Fuel Discount

4.1 The NHS Fuel Discount is only available at Participating Sites.  A list of Participating Sites is set out in the Schedule.  A Participating Site will display posters showing that the Reward is available at that filling station.  

4.2 To participate in the Reward, you must be an Eligible Customer and you must:

• attend a Participating Site;
• opt to pay at the kiosk (if the option is available at the fuel pump);
• fill, or top up, the vehicle’s fuel tank at the fuel pump;
• inform the attendant at a Participating Site before paying for fuel that you work for the NHS and are eligible for the NHS Fuel Discount;
• complete a paper voucher providing some basic personal details and give your consent to us processing your personal data (see below for details); and
• present a current and genuine photographic NHS identity card in your own name to the attendant who will check the details and return it;
• the attendant will apply the NHS Fuel Discount to the fuel price and the Eligible Customer should continue to pay for the fuel in the normal way.

5. Restrictions

5.1  Eligible Customers may only use the NHS Fuel Discount once for a single transaction during a single visit to the Participating Site.

5.2 The Promoter is unable to provide the NHS Fuel Discount if payment is completed at the pump by an Eligible Customer.

5.3 Participating Sites reserve the right to refuse to provide the NHS Fuel Discount if, at their discretion, there is reasonable cause to believe the Reward is being misused by an Eligible Customer or the claimant is not genuinely an Eligible Customer.  Examples of misuse of the Reward include (but are not limited to) attempts to utilise the NHS Fuel Discount for several different vehicles or an abnormal frequency of claims compared to typical customer behaviours.

5.4 The NHS Fuel Discount is available to the driver of the vehicle only, it is non-transferable, non-refundable and there is no cash alternative.  The NHS Fuel Discount applies only to purchases of Essar branded retail fuel, not to any other purchases in the Participate Site.

5.5 This Reward is available to Eligible Customers acting in their capacity as consumers only. 

5.6 The Reward may be used in conjunction with other in-store offers available at Participating Sites.

6. Promoter Rights

6.1 The Promoter reserves the right to cancel, terminate, modify or suspend the Reward or these Terms and Conditions, either in whole or in part, with or without notice. Any changes to these Terms and Conditions will be posted on www.essaroil.co.uk.

6.2 If for any reason the Reward is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, integrity or proper conduct of this Reward, the Promoter reserves the right to terminate, modify or suspend the Reward.

6.3 If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

7. Your personal data and privacy notices

7.1  The Promoter is the controller and is responsible for your personal data.  The Participating Sites are data processors who handle personal data on our behalf.

7.2 This privacy notice provides information on how the Promoter collects and processes your personal data.

7.3 We have appointed a data protection officer (DPO). 7.4 To participate in the NHS Fuel Discount scheme you will be asked to provide the following personal data:

• your first name and surname;
• your vehicle registration number;
• your NHS ID badge number; and
• your signature.

7.5 We will process the personal data above only if you indicate in the voucher that you give your consent to the processing activities set out in these terms and conditions.  Without your consent we cannot process your personal data or validate the discount therefore we cannot provide you with the NHS Fuel Discount.

7.6 Personal data will be submitted by the owner of the Participating Site to the Promoter for the purposes claiming the Promoter’s contribution to the cost of NHS Fuel Discount based on your purchase of fuel.  The Promoter will use the data for the purposes of administrating and managing the NHS Fuel Discount including monitoring and validating claims by the Participating Sites.

7.7 We may share your personal data with the DVLA or the NHS for the purposes of validating your identity only.  We will not transfer your data outside the UK.

7.8 We will keep records of your personal data for the duration of the Initial Reward Period and for such period afterwards as is reasonably necessary to complete the administration of the NHS Fuel Discount and or resolve any queries between the Promoter and owners of the Participating Sites.

You have the right to:

• Request access to your personal data
• Request correction of the personal data that we hold about you.
• Request erasure of your personal data.
• Object to processing of your personal data.
• Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
  • If you want us to establish the data's accuracy.
  • Where our use of the data is unlawful but you do not want us to erase it.
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal data to you or to a third party.
• Withdraw consent at any time where we are relying on consent to process your personal data.

8. Summary Terms and Conditions

• This Reward is available to NHS workers only, who present their personal original photographic NHS identity card when purchasing fuel for their own vehicle.
• NHS workers need to give consent to Essar processing specific personal data.
• A qualifying Purchase of Essar branded retail fuel is necessary.
• Incentive – 10ppl off the pump price as advertised on the day. Subject to availability and at participating Essar Service Stations only.
